1. Who we are

This website, coomax.co (“CooMax”, “we”, “us”), is operated by PINGOC NOW S.L., a company incorporated in Spain, holder of Spanish tax number (NIF) B72491368, with registered address at Calle de Francisco Zea 12, Local, 28028 Madrid, Spain.

You can reach us at [email protected] or on +34 644 098 320. Full identification details are set out in our Legal Notice.

2. What these Terms cover

These Terms and Conditions of Sale govern every purchase made through coomax.co. By ticking the acceptance box at checkout you confirm that you have read and accepted them. We recommend you save or print a copy: we do not file a separate copy of your individual contract beyond the order records in your account and the order confirmation we email you.

These Terms are drafted in English. The contract is governed by Spanish law, which is the law of the country where we are established.

3. Who can buy

You must be at least 18 years old and have legal capacity to enter into a binding contract. If you are buying on behalf of a business, you confirm you are authorised to do so.

4. Lawful use of the products

Our products are sold for lawful purposes only. You are responsible for checking that owning and using the product you buy is legal in your country and in the situation in which you intend to use it, and for complying with any applicable rules on privacy, recording and data protection. Please read Lawful use of our equipment before ordering. We do not sell to anyone who tells us they intend to use a product unlawfully, and we may cancel and refund any order where we have reasonable grounds to believe this is the case.

5. Products, prices and availability

Product images and descriptions are provided in good faith. Minor differences in colour, finish or packaging do not constitute a defect.

Prices include the applicable VAT. You can choose a display currency using the currency selector. Check the currency and final total shown at checkout before confirming your order. Shipping costs are calculated and shown separately at checkout, before you confirm the order.

We may change prices at any time, but the price that applies to your order is the one displayed when you place it. If a product is listed at an obviously incorrect price as a result of a technical or human error, we may cancel the order and refund you in full; we will contact you first.

Stock is not reserved until the order is confirmed. If a product becomes unavailable after you order it, we will tell you and either offer an alternative or refund you in full.

6. How the contract is formed

  1. You add products to the basket and complete the checkout, accepting these Terms.
  2. You pay using one of the methods below.
  3. We send you an order confirmation by email. The contract is formed when we send that confirmation.
  4. We send you a second email when the order ships, with tracking details where available.

7. Payment

We accept PayPal (including the local payment methods PayPal offers, such as iDEAL, Bancontact, BLIK, EPS, Przelewy24 and Multibanco), credit and debit cards, Apple Pay, Google Pay and Klarna, subject to availability in your country.

Payments are processed by our payment providers. We never see or store your full card number. If a payment is declined or reversed, we may suspend or cancel the order.

8. Shipping and delivery

We currently ship to Spain (mainland, Balearic Islands, Canary Islands, Ceuta and Melilla), Portugal, the rest of the European Union, the United Kingdom, other European countries outside the EU, the United States and other destinations offered at checkout. The countries available to you are those offered at checkout; if your country does not appear, we do not ship there.

Shipping costs depend on the destination and are shown at checkout before you pay. Delivery times are estimates, not guarantees, and do not include order processing time, customs clearance or delays caused by the carrier.

For deliveries outside the European Union customs duties, import taxes and clearance fees may apply. These are payable by you and are not included in the price or the shipping cost.

Risk of loss or damage passes to you when you, or a third party you have designated other than the carrier, take physical possession of the goods.

9. Your right to cancel (right of withdrawal)

If you are a consumer resident in the European Union, you have the right to withdraw from your purchase within 14 calendar days from the day you, or a third party you designated, took physical possession of the goods, without giving any reason.

To exercise it, tell us clearly before the 14 days expire, using our Returns Portal or by writing to [email protected] with your order number. You may use the model withdrawal form set out in Annex A of Spanish Royal Legislative Decree 1/2007, but you are not obliged to.

Return the goods without undue delay and in any event within 14 calendar days of telling us. You may examine and handle them as needed to establish their nature, characteristics and functioning, subject to the sealed-goods hygiene exception below. Please include all supplied accessories and use the original packaging where available.

Costs of returning goods

Where you withdraw for reasons unconnected with any fault on our side, a fixed return handling charge of €7.99 applies and is deducted from the amount refunded. When an applicable statutory right of withdrawal is exercised, we refund the original delivery cost, except any extra cost of a delivery method you expressly chose over the least expensive standard delivery offered. Configuration charges are not automatically excluded from a refund; any permitted payment for a service already provided is subject to the applicable statutory requirements, including proportionate payment where those rules apply.

Where the return is due to our error, a defective product or a problem attributable to the carrier, you pay nothing: we cover the return and refund the original shipping cost in full.

Refunds

We refund using the same payment method you used. For an applicable statutory withdrawal, we may withhold the refund only until we have received the returned goods or you have provided proof that you sent them back, whichever happens first, unless we have offered to collect the goods ourselves. For cash-on-delivery orders we offer a voucher with no expiry date or a bank transfer to an account held in your name.

Processing normally takes 2 to 7 working days from the day we receive the return, and never more than the statutory limit. Your bank may then take a further 2 to 10 working days to show the money.

Exceptions

The right of withdrawal does not apply to goods that were supplied sealed, are unsuitable for return for health-protection or hygiene reasons, and have been unsealed after delivery, in accordance with Article 103(e) of Royal Legislative Decree 1/2007. All these conditions must be met. This does not affect your rights where the product is faulty.

10. Product guarantee and statutory rights

All our products carry a 2-year commercial guarantee of conformity worldwide. For consumers in Spain, the 3-year statutory guarantee applies under Royal Decree-Law 7/2021. Our worldwide commercial guarantee does not replace or limit the mandatory statutory rights applicable in your country.

The guarantee covers manufacturing defects and failures under normal conditions of use. It does not cover damage caused by improper or negligent use, normal wear and tear, cosmetic damage that does not affect functioning, or unauthorised repairs or modifications.

To make a claim, contact us at [email protected] with your order number and a description of the problem. Nothing in these Terms limits your statutory rights as a consumer.

11. Order cancellation by us

We may cancel an order, refunding you in full, where the product is unavailable, where there has been an obvious pricing error, where the payment cannot be verified, where we cannot ship to your address, or where we have reasonable grounds to believe the order is fraudulent or intended for unlawful use.

12. Our liability

We are liable for foreseeable loss caused by our breach of these Terms. We are not liable for loss that was not foreseeable, for loss arising from your failure to follow the product instructions, or for any use of the product that breaches the law of your country.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.

13. Reviews

How we handle customer reviews, and what we do and do not verify, is explained in our Reviews Policy.

14. Your personal data

We process your personal data as described in our Privacy Policy, and use cookies as described in our Cookie Policy.

15. Complaints and dispute resolution

Please write to [email protected] first: most issues are resolved quickly that way.

If we cannot resolve it, you may contact the consumer protection authorities of the Autonomous Community of Madrid.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. If you are a consumer, you may bring proceedings in the courts of your country of residence, and you keep the protection of any mandatory rules of that country. If you are buying as a business, the courts of Madrid, Spain, have exclusive jurisdiction.

17. Changes to these Terms

We may update these Terms. The version that applies to your purchase is the one published on this page at the moment you place the order, and it does not change afterwards.
